Grizzly AI is a New Zealand company and handles personal information in accordance with the Privacy Act 2020 (NZ) (NZ Privacy Act). Where Grizzly AI is subject to the Privacy Act 1988 (Cth) (Australian Privacy Act) and the Australian Privacy Principles, Grizzly AI also complies with those obligations.

Although Grizzly AI will comply with this Privacy Policy in respect of information provided to Grizzly AI by persons under the age of 18 years, those persons must obtain the consent of a parent or guardian prior to using the Site and the parent or guardian will be responsible for appropriately supervising the person’s use of the Site.

Grizzly AI collects personal information when you use the Site, apply for employment with Grizzly AI, use Grizzly AI’s services or otherwise interact with Grizzly AI. This personal information includes your:

  • name;
  • contact information, such as your email address, home or work address and telephone number;
  • employer, job title and the organisation you represent;
  • preferences and/or opinions;
  • information you provide to Grizzly AI, including through feedback or otherwise;
  • details of services Grizzly AI has provided to you and/or that you have enquired about, your support requests, and Grizzly AI’s response to you;
  • where you apply for a job with Grizzly AI, your professional history, such as your previous employment and professional experience;
  • information about your access to and use of Grizzly AI’s services, including your IP address, browser type, domain names, access times and referring website addresses, your browser session and geo-location data, device and network information, and statistics on page views and sessions; and
  • any other personal information requested by Grizzly AI and/or provided by you or a third party.

Grizzly AI usually collects personal information directly from you. Grizzly AI may also collect it from third parties, such as your employer or organisation when it sets you up as a user of Grizzly AI’s services, and automatically through cookies and similar technologies when you use the Site or Grizzly AI’s services.

Grizzly AI encourages you to review the privacy statements of websites you choose to link to from Grizzly AI so that you can understand how those websites collect, use and share your information. Grizzly AI is not responsible for the privacy statements or other content on websites other than the Site.

Personal information in content you upload

When Grizzly AI’s customers use Grizzly AI’s software, they may upload documents and other content (Customer Data) that contains personal information. Grizzly AI handles Customer Data on behalf of the relevant customer, in accordance with the customer’s instructions and Grizzly AI’s agreement with that customer (including Grizzly AI’s Licence Terms or Master Software Licence and Services Agreement, as applicable), and for no other purpose. The customer is responsible for obtaining any consents and making any notifications required to provide that personal information to Grizzly AI.

Grizzly AI does not access Customer Data except as needed to provide its services to the customer, to provide support the customer has requested, or as required by law. Grizzly AI does not use Customer Data, or the outputs generated from it, to train or improve any AI model or large language model, whether its own or a third party’s, and uses reasonable endeavours to ensure that its contracts with large language model providers prevent those providers from doing so.

Use and disclosure of your personal information

Grizzly AI collects and uses your personal information for the primary purpose of operating the Site and delivering the services you have requested, and for purposes for which you would reasonably expect Grizzly AI to use that information. Grizzly AI also uses your personal information:

  • to inform you of other products or services available from Grizzly AI. Grizzly AI may use any email address or other personal information you provide to Grizzly AI at any time for this purpose;
  • for internal record keeping, administrative, billing and invoicing purposes;
  • if you have applied for employment with Grizzly AI, to consider your employment application;
  • to comply with Grizzly AI’s legal obligations or if otherwise required or authorised by law; and
  • to operate and improve Grizzly AI’s services, associated applications and associated social media platforms.

Grizzly AI will disclose your personal information, without notice, where it is necessary as part of Grizzly AI’s services, where Grizzly AI has your consent, or where permitted by law.

Grizzly AI does not sell, rent or lease its customer lists to third parties.

Grizzly AI may share your personal information with:

  • trusted service providers who help Grizzly AI operate its business and services, including its cloud hosting provider (Amazon Web Services), the large language model providers that power Grizzly AI’s software (OpenAI and Anthropic), and providers that help Grizzly AI perform statistical analysis, send you email and provide customer support;
  • advertising platforms Grizzly AI uses to promote its services, such as LinkedIn: when you book a demo, Grizzly AI may share a hashed (scrambled) version of your email address, your name, and an identifier for any ad you clicked, so the platform can tell Grizzly AI whether its ads led to the booking. These platforms may process this information overseas;
  • its employees, contractors and/or related entities;
  • professional advisors, insurers and insurance brokers; and
  • if Grizzly AI is acquired by, or merges with, another company, or sells its assets, its advisors or any prospective purchaser’s advisors, and your personal information may be part of the assets transferred.

All such third parties are prohibited from using your personal information except to provide these services to Grizzly AI, and they are required to maintain the confidentiality of your personal information.

Grizzly AI keeps track of the websites and pages its customers visit within Grizzly AI, in order to determine which Grizzly AI services are the most popular. This data is used to deliver customised content and advertising within Grizzly AI to customers whose behaviour indicates that they are interested in a particular subject area.

You may opt out of receiving marketing communications from Grizzly AI by emailing hello@grizzly.ai or by using the unsubscribe link in any marketing email. You agree and acknowledge that even if you opt out of receiving marketing material, Grizzly AI will still send you essential information that Grizzly AI is legally required to send you, or that relates to the services Grizzly AI provides to you. Once you opt out of receiving marketing material from Grizzly AI, you agree and acknowledge that removal from Grizzly AI’s distribution lists may take several business days after the date of your request to be removed.

Where your personal information is stored and overseas disclosure

Grizzly AI stores your personal information, including Customer Data, in Australia, using Amazon Web Services’ Sydney (ap-southeast-2) region. Grizzly AI is based in New Zealand, and Grizzly AI’s personnel may access personal information from New Zealand to fulfil the purposes set out in this Privacy Policy.

Outside New Zealand and Australia, some of Grizzly AI’s service providers (including its large language model providers) may process personal information in the United States. In many cases this will be necessary to provide Grizzly AI’s services.

Where Grizzly AI discloses personal information to a recipient overseas, Grizzly AI takes reasonable steps to ensure that the recipient is required to protect it in a way that, overall, provides comparable safeguards to those in the NZ Privacy Act and, where applicable, the Australian Privacy Principles, including through contractual arrangements with that recipient.

Use of cookies

The Site uses “cookies” to help you personalise your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the web server that you have returned to a specific page. For example, if you personalise Grizzly AI pages, or register with the Site or Grizzly AI’s services, a cookie helps Grizzly AI to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses. When you return to the Site, the information you previously provided can be retrieved, so you can easily use the Grizzly AI features that you customised.

You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of Grizzly AI’s services or the websites you visit.

Security of your personal information

Grizzly AI uses reasonable endeavours to secure your personal information from unauthorised access, use or disclosure. Grizzly AI stores the personal information you provide on computer servers in a controlled, secure environment, protected from unauthorised access, use or disclosure. Personal information is encrypted when it is transmitted over the internet, using encryption such as Transport Layer Security (TLS). Grizzly AI is certified to ISO/IEC 27001 (Information Security Management), and information about Grizzly AI’s security controls is available at https://trust.grizzly.ai.

Grizzly AI will only store your personal information for as long as Grizzly AI needs it for the reasons given in this Privacy Policy or to meet Grizzly AI’s legal and regulatory responsibilities. If Grizzly AI no longer needs your personal information, Grizzly AI will take reasonable steps to destroy it or make it anonymous, in accordance with Grizzly AI’s document and information retention policy, unless Grizzly AI is required by law or a court or tribunal order to retain it. Customer Data is deleted 30 days after the end of the relevant customer’s licence, in accordance with Grizzly AI’s agreement with that customer.

Unfortunately, data security can be breached. If this happens, Grizzly AI has procedures in place to quickly investigate the incident and determine whether your personal information has been affected. Where required, Grizzly AI will notify the Office of the Privacy Commissioner and affected individuals of a notifiable privacy breach under the NZ Privacy Act and, where applicable, will comply with the Notifiable Data Breaches scheme under the Australian Privacy Act.

Access to and correction of your personal information

You can ask to access, and request correction of, the personal information Grizzly AI holds about you at any time by emailing hello@grizzly.ai. Grizzly AI will respond to your request within a reasonable period of time (and in any event within the timeframes required by law) and, where it is reasonable and practical, Grizzly AI will give you access to the information in the format you requested, as allowed by the NZ Privacy Act and any other applicable privacy law.

Where permitted by law, Grizzly AI may charge a reasonable fee for the work involved in providing you with this information and for any associated costs. Grizzly AI will tell you about any fee before processing your request.

If you ask for your personal information held by Grizzly AI on behalf of a customer (for example, information in Customer Data), Grizzly AI may refer your request to that customer.

Changes to this Privacy Policy

Grizzly AI will occasionally update this Privacy Policy to reflect changes in the law, Grizzly AI’s services and company and customer feedback. Grizzly AI encourages you to periodically review this Privacy Policy to keep up to date with any changes.

Grizzly AI welcomes your comments regarding this Privacy Policy. If you believe that Grizzly AI has not adhered to this Privacy Policy or complied with its obligations under the NZ Privacy Act or any other applicable privacy law, please contact Grizzly AI at hello@grizzly.ai. Grizzly AI will respond to all questions and concerns within a reasonable time.

If you are not satisfied with Grizzly AI’s response, you may make a complaint to the Office of the Privacy Commissioner in New Zealand (www.privacy.org.nz) or, if you are in Australia, the Office of the Australian Information Commissioner (www.oaic.gov.au).
